Today’s question is: „Sergio, am I really required to undergo marriage counseling in order to qualify to obtain a divorce in Florida?“
The answer is simply ’no‘. You do not. There is no such requirement for you to undergo any kind of counseling or any other condition in order to qualify for a divorce in Florida.
Really what we need, from a legal perspective is that, in your sole and absolute discretion, you’ve decided that the marriage is irretrievably broken. And only you can decide that.
You don’t have to explain it, you don’t have to find any excuse or justification, and no one has to approve your divorce from a legal perspective; such as a judge, or a lawyer, or anybody else for that matter.
It’s all up to you and it’s purely your decision from a legal standpoint.
So, you can move forward with you divorce even though your spouse may disagree or object.
So, of course, you may choose for your own well-being, for your own moral obligation or religious obligation you may feel, to undergo some type of marriage counseling.
Again, that decision is yours, on one can force it on you.
Now, what if you are on the other side of this? What if you are the spouse who want to avoid the divorce and wants to try to reconcile and save the marriage?
Well, there is very little you can do as I just explained. Except for, maybe, reaching out to the other side either speaking with your spouse and/or speaking the spouse’s attorney, to try to slow down the process. We can even temporarily abate or freeze the divorce to give the parties the opportunity to undergo marriage counseling.
Again, if the other party doesn’t want to undergo any type of marriage counseling, there is no way to stop the whole divorce.
So, the only thing we can do, if you’re trying to save the marriage is to try to postpone or slow down the process. But there is no way to absolutely stop it if the other side is dead set on moving forward with the divorce.
